Tier II chemical inventory reports are required from all facilities which have reportable quanitities of chemcial products.

Clark County Tier II reports must be sent to

  1. Community Right-To-Know Unit, Department of Ecology, PO Box 47659, Olympia, WA 98504-7659,
  2. Your facility's local fire department, and
  3. Clark Regional Emergency Services Agency, 710 W. 13th Street, Vancouver, WA 98660-2810.
What chemicals are reported?

Any that you must have a MSDS for under OSHA's Hazard Communication standard. There are some exceptions.

What is the reportable quantity?

Extremely hazardous chemicals (listed in SARA Title III Section 313) are reported if you have more than 500 pounds or the Threshold Planning Quantity, whichever is less.

Any other hazardous chemicals are reported if you have more than 10,000 pounds.

When are these reports due?

March 1 for the preceding year.

What chemicals do not get counted under SARA Title III reporting?

These chemicals are not to be reported (paraphrase of EPA regulations, check Section 311(e) of Title III):

  1. food, food additive, color additive, drug, or cosmetic regulated by the FDA;
  2. substance present as a solid in any manufactured item to the extent that exposure does not occur under normal conditions of use;
  3. substance used for personal, family, or household purposes;
  4. substance that is used in a research laboratory or a hospital or medical facility under the direct supervision of a technically qualified person;
  5. substance used in routine agricultural operations or a fertilizer for sale.
